Supreme Court bans two-finger test in rape case

New Delhi: The Supreme Court has banned the two-finger test in rape cases. The court also warned that if a person is conducting such a test, the person will be considered guilty. On Monday, Justice D Y Chandrachud pronounced the verdict.

The court also ordered the removal of the two-finger test from the study material in the medical college. “Such an unscientific and aggressive way of examining the rape victim is to re-energise the woman who was sexually assaulted, and to recall what happened to her,” the court said. The judge said it was regrettable that a two-finger test is still taking place today.

In fact during the hearing, the Supreme Court set aside the order of the high court to release the accused in the rape and murder case. The court also sentenced the accused to life imprisonment. In 2013, the Supreme Court had termed the practice as unconstitutional and refused to hold such tests.

The central government has also termed the two-finger test as unscientific. In March 2014, the health ministry had also issued new guidelines for rape victims. In which the two-finger test was categorically denied. The victim was asked to physically examine and counsel her mentally.
